10 sample questions, with answers explained
Every question above with its correct answer and the reasoning behind it. Read the explanations for the ones you answered correctly too. A lucky guess and knowing the rule look identical on a score report. These are sample questions from our larger bank.
1. A Wisconsin licensee handles an accessible vacant lot and assumes inspection applies only to buildings. What does the rule require?
Why: The rule expressly covers accessible vacant land as well as improved property. The duty is a reasonably competent and diligent inspection for observable material adverse facts, not excavation of the entire parcel.
2. Wisconsin offers a 7-year adverse possession period to a possessor who entered under a recorded title claim. Beyond the conditions of the 10-year track, what must that possessor also do?
Why: Under Wis. Stat. 893.27, the possessor must pay "all real estate taxes, or other taxes levied, or payments required, in lieu of real estate taxes for the 7-year period after the original entry," and the conveyance must be recorded within 30 days after execution. A substantial enclosure is one way to show occupation, not the added condition, and no annual notice to the owner is required.
3. An owner selling a Wisconsin condominium unit must attach an addendum to the condition report. Which item must that addendum include?
Why: Wis. Stat. 709.02(2) requires the condominium addendum to state "the amount of current condominium assessments, fees, special assessments, or other charges for which a unit owner is responsible and whether the current charges for the unit have been paid," along with the condominium and association details and the executive summary. Budgets, reserve studies and minutes are not on that list.
4. A Wisconsin licensee's own inspection reveals facts materially contradicting the seller's statements. What must the licensee do about the inconsistency?
Why: The rule specifically requires timely written disclosure of material inconsistencies found in the licensee inspection. A seller's prior statement does not justify ignoring contradictory observed facts.
5. A Wisconsin licensee owns a building lot and will sell it only if the buyer lists the buyer's current home with the licensee. This condition is:
Why: REEB 24.075(2) bars conditioning the sale of real estate owned or controlled by the licensee on the buyer's agreement to list real estate with the licensee. The rule's note gives "requiring a buyer to list a present home with the licensee" as a common example of a violation.
6. REEB 24.08 requires licensees to put listing contracts, buyer agency agreements, offers to purchase and other written proposals in writing. When does that requirement NOT apply?
Why: REEB 24.08 "does not apply if the writing is completed by the parties or their attorneys" or if the writing is outside the scope of the licensee's authority under REEB 16. Family relationships, price and cash financing are not exceptions.
7. A buyer signed the DSPS-approved WB-36 Buyer Agency/Tenant Representation Agreement with Firm B. Does that form, by itself, grant Firm B an exclusive right to negotiate for the buyer?
Why: A note to REEB 24.13 states that the approved form WB-36 "does not grant the buyer's agent an exclusive right to negotiate." The rule also says a listing firm has no duty to investigate whether a buyer has granted a buyer's agent that exclusive right.
8. A Wisconsin seller of a single-family home must furnish the completed real estate condition report to the buyer by what deadline?
Why: Wis. Stat. 709.02(1) requires the owner to furnish the report "not later than 10 days after acceptance of a contract of sale or option contract." Wisconsin's timing runs after acceptance, unlike states that require the disclosure before an offer is made.
9. A Wisconsin buyer's licensee has property access, and no party instructs early submission before access. When should the required inspection occur?
Why: Nonlisting licensees generally inspect before submitting a written proposal. The access and instructed-early-submission exceptions are not present in this scenario.
10. A Wisconsin landlord's screening policy rejects applicants on each of the following grounds. Which one targets a status protected by Wis. Stat. 106.50(1)?
Why: Wis. Stat. 106.50(1) protects equal housing opportunity regardless of sex, race, color, sexual orientation, disability, religion, national origin, marital status, family status, status as a victim of domestic abuse, sexual assault, or stalking, lawful source of income, age, or ancestry. Occupation, smoking and political affiliation are not on that list.
