10 sample questions, with answers explained
Every question above with its correct answer and the reasoning behind it. Read the explanations for the ones you answered correctly too. A lucky guess and knowing the rule look identical on a score report. These are sample questions from our larger bank.
1. Priya passed her exam and wants her Nebraska salesperson license issued to active status with ABC Realty. What else must appear on the license issuance form?
Why: For active issuance the employing broker completes and signs the New Employing Broker Agreement to Employ on the issuance form. That section is marked not applicable if the applicant instead chooses issuance to inactive status. The 12-hour course comes after licensure.
2. Which post-license education requirement applies to a newly licensed Nebraska salesperson?
Why: Neb. Rev. Stat. 81-885.13(9) requires 12 hours of commission-approved class study (course 7000) within 180 days after license issuance. If the licensee misses it, the Commission places the license on inactive status until it receives the evidence.
3. A Nebraska broker mixes a principal's money into a personal account. What violation is identified?
Why: Commingling principal property with the broker's own property. Tracking the amount informally does not eliminate the prohibited mixing.
4. Does a Nebraska buyer's agent owe the seller an independent investigation of the buyer's financial condition under section 76-2418(3)(b)?
Why: No, the statute does not impose that independent investigation duty. The absence of an independent-investigation duty does not negate disclosure of adverse material facts actually known.
5. An Iowa broker in good standing wants a Nebraska license. How does the Nebraska Real Estate License Act treat license recognition?
Why: The Commission explains that a person holding a license in good standing in another real estate regulatory jurisdiction may be issued an equivalent Nebraska license, either while remaining a nonresident or upon moving directly from that jurisdiction. It is not limited to states with signed agreements.
6. When must a Nebraska seller give the buyer the Seller Property Condition Disclosure Statement?
Why: The instructions say the statement is to be given to the purchaser prior to the purchaser entering into any contract which would bind the purchaser to purchase. Any delivery after acceptance, after inspection or at closing is too late.
7. Under Neb. Rev. Stat. 25-202 and its case annotations, what is the statutory period for establishing title to Nebraska real estate by adverse possession?
Why: Section 25-202(1) bars an action to recover title or possession of land unless brought within 10 years after it accrues, and the annotations hold that the adverse possession period is ten years, proved by a preponderance of the evidence. Nebraska's period is 10 years, not 5, 15 or 20.
8. A Nebraska broker licensee decides to work for another broker's firm instead of running her own. In what capacity does she work?
Why: A Nebraska broker license allows practice either independently as a self-employed broker or as an associate broker employed by and under the direct supervision of a licensed broker at all times. She keeps the broker license and does not become a co-equal designated broker.
9. Nebraska law requires a licensee to present and explain the agency disclosure form to whom?
Why: The Commission states Nebraska law requires all licensees to present and explain the agency disclosure form to all unrepresented parties and potential parties in a real estate transaction. It is not limited to clients, to residential buyers or to people who request it.
10. A Nebraska team leader adds several members without updating the designated broker. What duty applies?
Why: Provide the designated broker a current team-member list. Section 81-885.24(31) imposes the leader's current-list duty.
