10 sample questions, with answers explained
Every question above with its correct answer and the reasoning behind it. Read the explanations for the ones you answered correctly too. A lucky guess and knowing the rule look identical on a score report. These are sample questions from our larger bank.
1. A qualified West Virginia resident requests a reasonable assistance-animal accommodation. The covered landlord demands its usual pet deposit as a condition. What applies?
Why: Code 16B-18-5(f)(10)(D) bars conditioning a reasonable assistance-animal accommodation on a pet fee or deposit. Ordinary pet terms do not control a qualifying accommodation.
2. A temporary West Virginia subdivision shelter is used to close transactions and permanently station licensees. Why can the shelter not rely on the West Virginia branch-office exception?
Why: The exemption depends on how the shelter is used: transactions must not be closed there and licensees must not be permanently assigned. Calling the structure temporary is not enough by itself.
3. A West Virginia applicant shows good cause for extra time to pay the license fee after passing. What extension may the Commission grant?
Why: Rule 1-4.7 allows a discretionary, one-time extension up to 3 months for good cause. It is neither automatic nor indefinitely renewable.
4. A West Virginia applicant submits another jurisdiction's license-status certification obtained 90 days before the application. Which timing requirement is not met?
Why: The rule requires each other jurisdiction's certification within the 60 days preceding the West Virginia application. A 90-day-old certification falls outside that stated window.
5. A West Virginia advertisement prints a team name 4 inches high. What minimum relative size applies to the required company and responsible-broker identification?
Why: The rule requires company name, responsible broker name and Broker designation at least half the size of associate, salesperson or team names. Half of 4 inches is 2 inches.
6. A West Virginia broker enters a cash-sweep-account agreement. When must a copy of the addendum be submitted to the Commission?
Why: The cash-sweep addendum must be submitted within 10 business days after entering the agreement. It is an agreement-based filing obligation rather than one triggered by a loss or closing.
7. A West Virginia branch-office sign shows the required names but uses half-inch lettering. Which physical-sign requirement is unmet?
Why: The office-sign rule requires the broker name, Broker designation and company name with lettering at least 1 inch high. Correct words in lettering below that minimum do not satisfy the rule.
8. A West Virginia team advertisement names an assistant who has no current license. What identification must accompany that person?
Why: Rule 1-17.1.b requires a named team member without a current valid license to be identified as Non-Licensed. Team membership does not confer a license.
9. A bank offers a West Virginia broker a personal bonus for maintaining an interest-bearing client trust account. May the broker keep it?
Why: Rule 1-15.4.b prohibits interest, privileges or other compensation from benefiting the broker or another licensee. Calling the payment a bonus does not avoid the prohibition.
10. A West Virginia broker opens a new trust account. Within what period must the Commission be notified?
Why: Code 30-40-18(k) requires notice within 10 days after establishing or changing a trust account. The notice is not limited to problematic accounts.
