10 sample questions, with answers explained
Every question above with its correct answer and the reasoning behind it. Read the explanations for the ones you answered correctly too. A lucky guess and knowing the rule look identical on a score report. These are sample questions from our larger bank.
1. A Mississippi licensee buys an ownership interest in a property through a transaction contract. What must the contract disclose under Rule 3.3(D)?
Why: 30 Miss. Admin. Code Part 1601 Rule 3.3(D) requires license status disclosure in all contracts in which the licensee has an ownership interest. The rule applies to all contracts in which the licensee has an ownership interest.
2. A Mississippi licensee completes approved CE beyond the required amount. What is the maximum approved carryover under Mississippi law?
Why: Miss. Code 73-35-18(1) caps approved excess CE carryover at six hours. Extra completion does not permit unlimited carryover into future renewal periods.
3. Unless the contract provides otherwise, what is the effect of delivering Mississippi’s statutory property disclosure to the transferee’s spouse?
Why: Section 89-1-517 treats delivery to the spouse as delivery to the transferee unless the contract states otherwise. The contractual exception must be respected.
4. A Mississippi broker titles a BPO report Certified Appraisal to impress a lender. What is the problem?
Why: Miss. Code 73-35-4(6) prohibits referring to a BPO as a valuation or appraisal. Changing the label does not turn a broker's price opinion into an appraisal.
5. A Mississippi escrow check is dishonored. What should the broker do under Rule 3.4?
Why: Rule 3.4 requires immediate notice to all transaction parties when an accepted escrow check is not honored. Silence does not cure the missing funds.
6. An independent Mississippi E&O carrier does not offer a noncancelable policy. What alternative commitment is required by the Mississippi rule?
Why: Miss. Code 73-35-16(7)(d) requires an alternative carrier to offer a noncancelable policy or commit to commission notice 30 days before intended cancellation. The statutory alternative is advance commission notice, not merely notice to the insured.
7. A Mississippi licensee prepares a written BPO. What insurance-related certification is required?
Why: Miss. Code 73-35-4(4)(k) requires a BPO to certify legally required E&O coverage for BPO preparation liability. The certification concerns the preparer's applicable professional coverage.
8. After delivering Mississippi's statutory disclosure, a transferor learns information requiring a correction. Which statement is accurate?
Why: Miss. Code 89-1-515 allows written transferor amendments subject to the statutory delivery and buyer termination provisions. Written amendment does not erase the applicable delivery and termination framework.
9. A Mississippi state-program insured goes inactive and reactivates during the same policy period. What additional state-program premium is charged solely because of that reactivation?
Why: Miss. Code 73-35-16(8)(c) charges no additional state-program premium for reactivation during the same policy period. The same-policy-period limit matters; this does not promise free coverage for a later policy period.
10. Before a Mississippi disciplinary hearing, the respondent and commission reach a mutually acceptable resolution. What procedure does the statute authorize?
Why: Miss. Code 73-35-23(8) allows resolving a complaint through an agreed order before the hearing. An agreed order is an authorized resolution method before hearing.
