1. A Georgia broker hires an unlicensed assistant. Under GREC Rule 520-1-.07(6), which statement describes what the assistant may do?
Why: Under Rule 520-1-.07(6)(a), support personnel may perform only ministerial duties, those that do not require discretion or the exercise of their own judgment, and they may not perform the brokerage activities of a licensee. Rule 520-1-.07(6)(f) separately bars them from collecting or holding deposit monies, rent or anything of value from an owner or a prospective purchaser or lessee. Supervision does not unlock licensed work.
2. A newly licensed, active Georgia salesperson is asked by a neighbor to find a tenant for his rental house for a fee. How may she do this work?
Why: GREC Rule 520-1-.05(g) requires every active licensee performing real estate brokerage activity to do so as a broker or on behalf of a real estate broker. A salesperson cannot run brokerage work independently, and going inactive would only narrow what she may do, to real estate she solely owns.
3. A Tennessee resident who earned her Tennessee license by passing that state's exam, and who is in good standing, applies for a Georgia license by reciprocity. What exam requirement applies?
Why: GREC offers licensing by reciprocity to licensees from all states whose license was obtained by passing an exam in that state and is in good standing, and it waives the entire examination. Only Florida residents must pass the Georgia state portion. Georgia's model is universal, not bilateral.
4. A Georgia licensee has been showing homes to a buyer for a week without giving any written brokerage relationship disclosure. Under GREC Rule 520-1-.06(4)(b), what is the latest point by which the disclosure must be made?
Why: The rule requires the written disclosure to be made in a timely manner, but in any event not later than the time that any party first makes an offer to purchase, to sell, to lease, or to exchange real property. A deadline after acceptance, at loan application or at closing comes too late, because the first offer is the outer limit.
5. Which Georgia salesperson, whose license lapsed for missing the post-license deadline, may reinstate it without paying a reinstatement fee?
Why: GREC's reinstatement form waives the fee only if the salesperson enrolled in the course by the due date and completed and passed the course examination within six months of the due date. Reinstating within four months of the lapse is cheaper than waiting, but it still costs a fee if those two conditions are not met.
6. A Georgia salesperson license has been lapsed for six years because the post-license course was never completed. How may the former licensee return to practice?
Why: GREC Rule 520-1-.05 says a license lapsed for more than five years is reinstated only by re-qualifying as an original applicant. The fee-plus-course reinstatement route is for shorter lapses, and a preliminary decision concerns criminal history, not lapsed education.
7. A Georgia broker disburses earnest money under a reasonable interpretation of the contract, but the buyer never expressly agreed to the disbursal. What must the broker do?
Why: Rule 520-1-.08(3)(c) says that when a broker makes a disbursal to which all parties to the contract do not expressly agree, the broker must immediately notify all parties in writing of the disbursal. The notice goes to the parties, not the Commission, and the rule imposes no 30-day waiting period.
8. After a Georgia sale falls apart, the buyer and the seller each demand the $5,000 earnest money, and neither will sign a release. Which step lets the broker properly disburse the funds under GREC Rule 520-1-.08(3)(b)?
Why: Rule 520-1-.08(3)(b) lists the occasions for disbursing trust funds, including upon the filing of an interpleader action in a court of competent jurisdiction, upon a court order, and upon a written agreement signed by all parties with an interest in the funds that is separate from the contract. An even split, a referral to the Commission and one party's oral instruction are not on that list.
9. How much continuing education must a Georgia licensee complete to renew?
Why: GREC Rule 520-1-.05 requires 36 instructional hours of continuing education during the renewal period, and Georgia's renewal period is four years. That works out to 9 hours a year, so a two-year reading triples the load. Twenty-five hours is the one-time post-license course, not CE.
10. A Georgia applicant whose license was denied lets the hearing-request deadline pass without filing anything. What follows?
Why: Under GREC rules, if no timely written hearing request is made, the application lapses. A new application then requires passing the examination again and paying the fees again. There is no automatic review and no fallback inactive license.
