1. A fiduciary transfers Delaware property during administration of a decedent’s estate. How does the statutory seller-disclosure subchapter treat that transfer?
Why: 6 Del. C. 2577 exempts the fiduciary’s administration transfer. This does not establish that a later sale personally made by an heir is also exempt.
2. A covered Delaware wholesale sale contract contains the required disclosures. What is the seller-consumer’s cancellation deadline?
Why: Current Section 2940 allows cancellation through midnight of day 21 or conveyance, whichever occurs first. The rule applies to the defined wholesale transaction.
3. Which task fits Delaware's limited unlicensed property-management exemption?
Why: 24 DE Admin. Code 2900 Rule 9.1 limits the unlicensed property-management exemption to maintenance, administrative support and collection of funds payable to the owner or brokerage.
4. A Delaware licensee has not been specifically hired as a common-law agent by written agreement. What agency framework generally applies?
Why: 24 Del. C. 2936 presumes statutory agency unless a written brokerage agreement specifically hires the licensee as a common-law agent.
5. What minimum age applies to a Delaware associate broker applicant?
Why: 24 Del. C. 2907(c)(2) requires associate broker applicants to be at least 23.
6. When must a Delaware written hardship CE waiver or postponement request reach the Commission?
Why: 24 DE Admin. Code 2900 Rule 14.8 requires a written hardship CE waiver or postponement request at least 60 days before biennial renewal.
7. A Delaware team advertises its name prominently. How must the supervising brokerage name appear?
Why: Rule 8.6.5.4 requires the brokerage name next to the team name with greater size and visibility. The team must not obscure its supervising brokerage.
8. A Delaware buyer is to pay a fee under an exclusive buyer agency arrangement. What form is required?
Why: 24 DE Admin. Code 2900 Rule 8.2.1 requires written buyer-signed exclusive or buyer-payment agency agreements.
9. How is Delaware’s nine-member Real Estate Commission divided?
Why: 24 Del. C. 2903 requires 5 professional and 4 public members. Professional representation does not eliminate the public seats.
10. A Delaware licensee actually knows an adverse material property fact. What must be done for prospective buyers or tenants?
Why: Section 2936 requires disclosure of adverse material facts actually known to the licensee. The prospect’s inspection does not excuse concealing known facts.
