10 sample questions, with answers explained
Every question above with its correct answer and the reasoning behind it. Read the explanations for the ones you answered correctly too. A lucky guess and knowing the rule look identical on a score report. These are sample questions from our larger bank.
1. In 2026, an Illinois licensee living in Illinois asks whether she can get a Florida license through mutual recognition. What does FREC's current information show?
Why: FREC now lists mutual recognition with nine states and shows "Illinois: Agreement Dissolved" on December 31, 2025. Older lists that still name Illinois are out of date.
2. A Florida licensee will act as a single agent for a buyer. She plans to show homes on Saturday and sign a representation agreement on Monday. When must the single agent duties be disclosed in writing?
Why: Section 475.278(3)(b)1. requires the disclosure "before, or at the time of, entering into a listing agreement or an agreement for representation or before the showing of property, whichever occurs first." The Saturday showings come first, so waiting until Monday is too late.
3. A Florida sales associate deposits a buyer's escrow check into her personal bank account. This violation is called:
Why: Mixing client funds with personal funds is commingling. If she then spends the money, the violation escalates to conversion.
4. Under Florida statutes, how long must actual, continued possession last for adverse possession, whether or not the claimant has color of title?
Why: Florida uses 7 years on both tracks: Fla. Stat. 95.16 (under color of title) and 95.18 (without color of title). Other states differ: Washington uses 10 years and Minnesota 15.
5. A newly licensed Florida broker fails to complete the 60 hours of broker post-licensing education before the first renewal. What follows?
Why: Under Fla. Stat. 475.17(4)(c), the broker license becomes null and void. The person may be issued a sales associate license after completing the 14-hour continuing education course within 6 months of expiry, and must retake the broker course and exam to operate as a broker again.
6. The Florida Real Estate Commission finds a sales associate guilty on three separate counts. What is the largest total administrative fine it may impose?
Why: Section 475.25(1) caps the fine at $5,000 "for each count or separate offense." Three counts times $5,000 equals $15,000. Reading $5,000 as a cap on the whole case gives the trap answer.
7. A Florida broker's written listing agreement has a definite expiration date. Which added clause would violate Fla. Stat. 475.25(1)(r)?
Why: Section 475.25(1)(r) requires a definite expiration date, a property description, price and terms, the fee or commission, and the principal's signature. The agreement "shall contain no provision requiring the person signing the listing to notify the broker of the intention to cancel the listing after such definite expiration date." A signed copy goes to the principal within 24 hours.
8. A Florida broker personally receives a buyer's earnest money check on a Friday. The following week has no legal holidays. To meet the "immediately" requirement of Rule 61J2-14.008(3), by when must the check be placed in the escrow account?
Why: Rule 61J2-14.008(3) defines "immediately" as placement in escrow "no later than the end of the third business day following receipt." Saturdays, Sundays and legal holidays are not business days, so Monday, Tuesday and Wednesday are days 1 to 3. Counting the weekend gives Monday, and the next-business-day deadline applies to a sales associate handing a deposit to the broker.
9. A Florida seller's former tenant was diagnosed with AIDS while living in the home. How does Florida law treat this fact?
Why: Fla. Stat. 689.25 expressly excludes from disclosure that an occupant is or was infected with HIV or diagnosed with AIDS, and bars any cause of action against an owner, agent, or licensee for not disclosing it. Students often expect the duty to run the other way.
10. Florida's real estate license law, administered by the Florida Real Estate Commission within DBPR, is found mainly in which chapter of the Florida Statutes?
Why: Chapter 475 is the real estate license law, covering qualifications (475.17) and brokerage relationships (475.278). Chapter 95 holds the adverse possession periods, 689 holds the 689.25 disclosure exemption, and 712 the Marketable Record Title Act.
