10 sample questions, with answers explained
Every question above with its correct answer and the reasoning behind it. Read the explanations for the ones you answered correctly too. A lucky guess and knowing the rule look identical on a score report. These are sample questions from our larger bank.
1. A Pennsylvania candidate has passed both portions of the salesperson exam but has not yet chosen a brokerage. What does the Department of State licensure guide say about applying for her license now?
Why: The guide says "You may not apply for a Real Estate Sales license until you have an employing broker who holds a valid PA Real Estate Broker license." Some states, such as Texas, issue an inactive license without a sponsor, but Pennsylvania puts the broker before the application.
2. Which of these Pennsylvania residential transfers is exempt from the Seller Disclosure Law?
Why: 68 Pa.C.S. 7103(b)(3) exempts a transfer "From one co-owner to one or more other co-owners." A lease with an option to purchase is a trap: section 7103(a) expressly includes it, and duplexes and condominium units fall within the one-to-four-unit coverage.
3. A salesperson is renewing a Pennsylvania license that was first issued within 6 months of the biennial period being renewed. What does 49 Pa. Code 35.383 provide about her continuing education?
Why: Under 35.383(a)(1), a license "initially issued within 6 months of the biennial license period for which renewal is sought" is "deemed eligible, on the basis of hardship, for a full waiver of the continuing education requirement." Waiver requests are due to the Commission by March 31 of the renewal year.
4. A Pennsylvania consumer asks a licensee for a structural engineering conclusion outside the licensee's expertise. What duty applies?
Why: The general duty requires advising consumers to seek expert advice on matters beyond the licensee's expertise. The licensee should recognize that limit rather than supplying unsupported specialist conclusions.
5. A Pennsylvania licensee also owns a repair service and tells a buyer that using it is required. What does the ancillary-services rule prohibit?
Why: The rule bars requiring consumer use of the listed ancillary services, including repair and inspection services. Disclosure of an interest and freedom of consumer choice are separate considerations.
6. A Pennsylvania salesperson let her standard license become noncurrent and now wants to reactivate it. What continuing education does 49 Pa. Code 35.382(b) require?
Why: Reactivation requires "14 hours of Commission-approved continuing education during the 2-year period preceding the date of submission of the reactivation application," and the same coursework may not be used to satisfy both the reactivation and the renewal requirement.
7. A salesperson held an active Virginia license until two years ago and now wants a standard Pennsylvania salesperson license. Which examination must she pass?
Why: Salespersons "who have held an active salesperson license in another state within the last five years do not need to complete the General/National portion." She must still pass the Pennsylvania state portion, so recent licensure waives only the national part, not the whole exam.
8. An applicant has a forgery conviction, a non-violent offense on the State Real Estate Commission's schedule. Under 49 Pa. Code 43b.452, after how many years does it stop being considered directly related to the profession?
Why: A scheduled conviction "will no longer be considered directly related to the profession or occupation if at least 5 years have passed since the individual's conviction of that offense." The 3-year figure belongs to the separate crimes-of-violence rule, and 10 years is Washington's look-back, not Pennsylvania's.
9. What must a Pennsylvania salesperson with a current standard license complete as a condition of renewal?
Why: 49 Pa. Code 35.382(a) requires "14 hours of Commission-approved continuing education during the preceding license period," completed "by the May 31 renewal deadline." March 31 is the deadline for filing a CE waiver request, not for finishing the hours.
10. A Pennsylvania applicant with an unusual education history asks the State Real Estate Commission to look over her documents and tell her whether she qualifies before she applies. What does the licensure guide say?
Why: The Department of State guide says "The Real Estate Commission cannot pre-review application materials or qualifications." She must submit an application with all required documentation to receive a determination. Only applicants with criminal convictions have a separate route, the preliminary determination request.
