What Is Dual Agency in Real Estate?
Dual agency is one broker representing both the buyer and the seller in the same transaction, lawful only with the informed written consent of both and stripped of full loyalty and advocacy. Undisclosed dual agency is a licence violation, and several states ban the practice outright.

1. Dual agency exists when:
Why: The defining feature is one brokerage owing fiduciary duties to both sides of a single transaction. Two firms cooperating is ordinary practice and creates no conflict, because each side has its own advocate.
2. Where dual agency is permitted, it is lawful only with:
Why: Both principals must understand what they are giving up and consent in writing, ideally before an offer is written. Consent from only the paying party is worthless, because the conflict harms whichever side was not asked.
3. Undisclosed dual agency exposes the broker to all of the following EXCEPT:
Why: Forfeited fees, rescission and license discipline are all standard consequences of a secret conflict of interest. The buyer's loan is a separate contract with a lender and is unaffected by the broker's misconduct.
4. The fiduciary duty most fundamentally compromised by dual agency is:
Why: A dual agent cannot place one client's interests above all others when both parties are her clients, so loyalty becomes divided by definition. Accounting for funds and exercising reasonable care remain fully intact.
5. The practical advantage of designated agency over dual agency for the consumer is that:
Why: Under designated agency each side still gets counsel on strategy and price, which a dual agent is barred from giving. Disclosure requirements are not relaxed — designated agency must itself be disclosed and consented to.
6. A broker representing both the seller and the buyer in the same transaction has obtained a signed dual agency consent from each party. What may the broker still NOT do?
Why: Even with written consent, a dual agent must keep each side's confidential bargaining information private, so revealing the lowest price the seller would accept is forbidden. Disclosing a known foundation crack is not confidential information but a material defect that must be revealed regardless of who the broker represents.
7. Consent to dual agency is legally effective only when it is:
Why: Dual agency requires informed written consent obtained before the broker begins representing both sides, so the parties can decide knowing what duties they give up. Continuing to work with the broker is not consent because implied or after-the-fact consent leaves the parties uninformed at the moment the conflict arises.
8. Arkansas clients consent to dual agency. What does 17-42-316(b)(1)(B) permit them to waive contractually?
Why: The statute permits the specified contractual waiver by consenting dual-agency clients. That limited authorization is not a waiver of all laws or the regulator's authority.
