What Is Designated Agency in Real Estate?

Definition

Designated agency is the broker appointing one licensee to represent the seller and a different licensee to represent the buyer in the same in-house sale, so each client keeps a full fiduciary advocate while the supervising broker stays neutral. It exists to avoid true dual agency.

  1. 1. Designated agency, where permitted, means that:

    • AThe broker designates a licensee to act as a neutral facilitator
    • BThe broker appoints one licensee to represent the seller and another to represent the buyercorrect
    • CThe seller designates which cooperating brokers may show the property
    • DOne licensee represents both parties with written consent

Why: The managing broker names individual licensees to advocate for each side, so each principal keeps a genuine advocate inside the same firm. Where one licensee represents both parties, the arrangement is dual agency rather than designated agency.

  2. 2. In a state that authorizes designated agency, what is typically true of the managing broker who makes the appointments?

    • AShe occupies a dual position and must remain neutralcorrect
    • BShe must resign from the transaction entirely
    • CShe becomes the buyer's agent only
    • DShe has no relationship with either party

Why: The broker still owes duties to both clients through the firm, so she stays neutral and does not leak one designated agent's confidences to the other. That neutrality is what makes the two designated agents' separate advocacy workable.

    Agency

  3. 3. The practical advantage of designated agency over dual agency for the consumer is that:

    • AEach party retains an advocate who can advise on price and termscorrect
    • BNo agency disclosure form is required
    • CNeither party owes the brokerage any compensation
    • DCommissions are reduced by statute

Why: Under designated agency each side still gets counsel on strategy and price, which a dual agent is barred from giving. Disclosure requirements are not relaxed — designated agency must itself be disclosed and consented to.

    Agency

  4. 4. In designated agency, which statement best describes the broker-in-charge's position?

    • AThe broker-in-charge personally represents whichever party signed a written agreement with the firm first, to the exclusion of the other
    • BThe broker-in-charge is a transaction broker for both parties by law
    • CThe broker-in-charge appoints separate licensees to each party and supervises without favoring eithercorrect
    • DThe broker-in-charge becomes the sole agent of the seller only

Why: Designated agency lets the broker appoint one affiliated licensee to the seller and another to the buyer, with the broker supervising in a neutral position. The broker does not become the seller's sole agent, because the firm holds both agency relationships at once through the appointed licensees.

  5. 5. Sunrise Realty uses designated agency. Licensee Patel is appointed to the seller and licensee Nowak to the buyer on the same listing. Which practice best preserves the integrity of the arrangement?

    • AHaving the two licensees compare their clients' negotiating limits weekly
    • BRotating the two files between licensees so both learn the whole deal
    • CStoring both files in a shared drive folder open to all firm licensees
    • DKeeping each side's confidential information walled off from the other licenseecorrect

Why: A firewall that keeps each client's confidential information from the other appointed licensee is what makes designated agency workable. A shared drive open to all licensees defeats the purpose, because access to the other side's bargaining limits is exactly what the firewall must prevent.

    Agency

  6. 6. An Illinois sponsoring broker names Maria as the designated agent for a new seller client. By when must Maria advise the seller in writing that a designated agency relationship exists and name the designated agent?

    • ABefore the first showing of the property
    • BBefore the seller signs a purchase contract
    • CWithin 24 hours after the listing enters the MLS
    • DNo later than beginning to work as the seller's designated agentcorrect

Why: Under 225 ILCS 454/15-35(a), a designated agent must advise the consumer in writing, no later than beginning to work as a designated agent on the consumer's behalf, that a designated agency relationship exists and give the name or names of the designated agents. Waiting for a showing, a contract or an MLS entry is too late.

  7. 7. A Kentucky broker establishes designated agency. What is required for the appointments?

    • AWritten appointments communicated to affiliates with the represented consumer’s consentcorrect
    • BA promise that everyone in the office represents both parties
    • CAn unrecorded internal conversation only
    • DA buyer’s lender selecting both agents

Why: KRS 324.121 requires written designation, communication to affiliated licensees and consumer consent. Designated agency is not created merely by office custom.

    Agency

  8. 8. A Massachusetts broker appoints salesperson Ana as designated seller's agent and salesperson Ben, from the same firm, as designated buyer's agent on the same house. Both clients consented to designated agency. What is the appointing broker's role?

    • AA sub-agent of the buyer
    • BA dual agent, neutral as to conflicting interestscorrect
    • CA facilitator owing no duties to either party
    • DThe seller's agent, because the listing came first

Why: Under 254 CMR 3.00(13)(c), if designated agents affiliated with the same broker represent the seller and the purchaser, the appointing broker becomes a dual agent, neutral as to conflicting interests, while still owing both parties confidentiality and accounting for funds. When both clients consented to designated agency, no separate dual agency consent is required.

Where designated agency sits in the exam vocabulary

Designated Agency is a agency relationship, and so are dual agency, subagency and transaction broker. That matters more than it sounds: a multiple-choice item builds its wrong answers out of siblings like these, because they are the options that look plausible to someone who has learned the category but not the distinction. If designated agency appears as the correct answer, expect to see dual agency and subagency on the same screen.

Designated Agency does not stand on its own: it assumes you already know dual agency and fiduciary duty. Questions that look like they are testing designated agency are often really testing whether those ideas are solid underneath it.

The exam most often tries to catch you by putting designated agency next to dual agency. Each of those is a real concept sitting close enough to be tempting, and the question usually turns on the single feature that separates them rather than on the definition of either one. Read the contrast, not the term.
