What Is Spot Zoning in Real Estate?

Definition

Spot zoning is the illegal rezoning of a single small parcel for the benefit of its owner in a way that conflicts with the surrounding district and the comprehensive plan. Courts strike it down because zoning must serve the general public welfare rather than one landowner.

  1. 1. Rezoning a single small parcel to benefit its owner, inconsistent with the surrounding area, is:

    • AInverse condemnation
    • BA buffer zone
    • CDownzoning
    • DSpot zoningcorrect

Why: Spot zoning singles out one parcel for treatment out of step with the comprehensive plan, and courts frequently strike it down as arbitrary.

  2. 2. A council rezones a single interior lot in an established residential block to permit a drive-through restaurant, leaving surrounding parcels unchanged. A court is most likely to call this:

    • AExclusionary zoning
    • BSpot zoningcorrect
    • CA conditional use
    • DAesthetic regulation

Why: Singling out one small parcel for treatment inconsistent with the surrounding district and the comprehensive plan is spot zoning, which courts void as a private benefit. Exclusionary zoning describes townwide rules that price out lower-income households.

    Land use controls

  3. 3. A suburb requires five-acre minimum lots, prohibits multifamily buildings and bars manufactured homes throughout the town. This pattern is most often challenged as:

    • ASpot zoning
    • BCumulative zoning
    • CA nonconforming use
    • DExclusionary zoningcorrect

Why: Regulations whose combined effect keeps out lower-cost housing and the households who need it are attacked as exclusionary zoning. Spot zoning is a different defect, involving favorable treatment given to one small parcel.

Where spot zoning sits in the exam vocabulary

Spot Zoning is a improper zoning action, and so are variance and conditional use permit. That matters more than it sounds: a multiple-choice item builds its wrong answers out of siblings like these, because they are the options that look plausible to someone who has learned the category but not the distinction. If spot zoning appears as the correct answer, expect to see variance and conditional use permit on the same screen.

Spot Zoning does not stand on its own: it assumes you already know zoning. Questions that look like they are testing spot zoning are often really testing whether that idea is solid underneath it.

The exam most often tries to catch you by putting spot zoning next to variance and conditional use permit. Each of those is a real concept sitting close enough to be tempting, and the question usually turns on the single feature that separates them rather than on the definition of either one. Read the contrast, not the term.
